Dispute Resolution and Litigation
I have acted as counsel on numerous mediations and arbitrations. I am trained as a mediator and arbitrator through the World Intellectual Property Organization (WIPO) Mediation and Arbitration Centre, and as a mediator by the International Trademark Association (INTA). I am on the panel of mediators for the WIPO and the INTA and of arbitrators for the WIPO. I was formerly a member of the Arbitration Core Group at Norton Rose Fulbright until my retirement from that firm, and also a member of the Arbitration Committee of the Canadian Chamber of Commerce. I am a member of IP Neutrals of Canada. I have acted as counsel in an arbitration for Timberjack (John Deere) involving 5 US and Canadian patents before a retired US court district judge and in media and entertainment arbitrations for Fox, Sony and Marvin Hamlisch as well as numerous mediations relating to all kinds of intellectual property. I have experience at all levels of courts as lead counsel in intellectual property cases (see my detailed cv on this site) and am available to provide advice or counsel to those individuals or firms who might need a review of their dispute either as a neutral or as an advocate. I can do as little or as much as you might need by assisting either the client directly or its counsel, either reviewing pleadings or written arguments, assisting in oral arguments or cross-examinations or simply being a sober second look to evaluate your case. Taking over your case would not be my first choice, but would do so on request. I am especially interested in assisting on appellate briefs.
